The Employment and Labour Relations Court in Mombasa found that manager Alex Omani’s termination was both procedurally and substantively unfair.
Justice Agnes Nzei ruled that Vipingo Ridge Services failed to follow the mandatory procedures set out in Section 41 of the Employment Act.
The court determined that Omani was not allowed to defend himself against the allegations before his dismissal.

Justice Nzei noted that the company did not prove the allegations of poor performance cited in its pleadings and testimony.
Vipingo Ridge Services was also directed to issue Omani a certificate of service.
Omani was employed by the company from September 8, 2021, until January 31, 2023, under a written contract.
In addition to compensation, the court awarded him one month’s salary instead of notice.
